Senior Associate – Real Estate Disputes (0197)

The Role

Our client is looking for an experienced solicitor to join the Real Estate Disputes (“RED”) team based in their Birmingham office. There is an existing team of four fee earners in the office, and you will also be working with two highly regarded partners as part of the national RED team.

You will undertake a stimulating combination of consultancy and active litigation on a variety of complex matters. The client base is primarily on the commercial side, providing strategic advice to investors, developers, charities, educational establishments, and healthcare clients. The team also handles matters generated from their insurance and private client teams.

A key aspect of this role is working closely with our client’s large non-contentious real estate team, advising clients on property issues where an advantage can be gained or a problem avoided. They focus as much on preventing disputes as they do on handling litigation.

Where a client has a dispute, the team takes the matter through to settlement or trial. The goal is to provide practical yet high-quality advice on property issues, informed by the knowledge and experience of litigating them, as well as the ability to take them through the litigation process where necessary.

The types of issues the team handles include possession and forfeiture, lease renewal, rent reviews, adverse possession, option disputes, rights of way, and protestor injunctions. While asset management work is part of the practice, one of our client’s differentiators from other RED teams is the variety of work available, ensuring the successful candidate will find the role both stimulating and challenging.

Litigation is conducted in High and County Courts, as well as the First Tier and Upper Tribunals. The team also explores alternative dispute resolution methods, including arbitration and expert determination.

Our client has significant expertise working with local and central government, prestigious universities and colleges, NHS trusts, and charities. While certain team members specialize in areas such as business rates, agricultural tenancies, telecoms, professional negligence, and legal indemnity work, you will be expected to engage with a broad and stimulating range of matters.

You will manage your own matters, supervising and delegating tasks to junior team members as appropriate, while also assisting partners on more substantial cases and collaborating with RED colleagues nationally. Additionally, you will be expected to contribute to the team’s marketing and seminar activities.

The Person

You will be 5+ years PQE with hands-on real estate disputes experience gained from a respected firm, particularly with tribunal and court work.
